Lawyer sues DWP for disability discrimination

A lawyer is suing the Department of Work and Pensions (DWP) for disability discrimination in a legal case believed to be the first of its kind in Scotland.

Daniel Donaldson, 37, has lodged a civil action at Glasgow Sheriff where he is seeking compensation for his disability benefit being incorrectly stopped.

If successful, the solicitor, from Glasgow, believes his case will open the floodgates for other disabled people to do the same.

Mr Donaldson suffers from depression, anxiety and a number of other health problems.

He said: “I raised this action because I’m sick and tired of the way our politicians are treating disabled people.

“I went through a really hard time with this – I got into debt, was overdrawn, and I really began to question myself. Now I feel like I need to make a stand.

“I hope by demonstrating leadership and in taking this case to court, more disabled people will gain courage and the confidence to challenge our political leaders for choosing specifically to discriminate against them.”

The case, which also lists the Scottish Government as respondents, centres on Mr Donaldson’s Personal Independence Payments (PIP).

I concur, in my experience people suffering depression and anxiety rarely want to add to it with a long drawn out legal battle. :dunno:

I think they should reassess him in light of this development. Now he wants thousands more of the tax payers' money, some of it from those on minimum wage who have to pay tax. Don't these people have any gratitude?

I concur, in my experience people suffering depression and anxiety rarely want to add to it with a long drawn out legal battle. :dunno:


You don't have to attend now.

You can just submit a statement along with medical records etc..

The court sets a date for reassessment, normally you get about two years.

You can tell by their actions. Such actions are not those of a person suffering from severe depression and anxiety IMO.

Maybe he's on the mend. That doesn't mean he wasn't or isn't suffering now. He could earn a fortune in his job. Do you really think someone of the right mind would resort to benefits when it's so easy to get good money? Maybe he just had a bad spell. I know the rules are very strict and he wouldn't have been in receipt of any help if it wasn't legit.

Oh. That sounds good. How do I go about getting that :laughing:

There must be some means testing. You can't just get benefits if you're not entitled to it.
