Fact. He was still drunk from the night before or he had been boozing during the day. Nobody could have forced it on him.

He is, but I agree the people he crashed his car into whilst being drunk behind the wheel will be in a state of shock and some may be injured. I imagine the parents of the three year old child are not very concerned about him having a hard time when he could have killed her. If he's convicted at least he will have his licence removed for a while.
