Settle an argument please.

Wife bought a tea-set online privately, £56, not from Ebay, and it's come poorly packed with only a couple of pieces of brown paper screwed up in a box with it. Well the tea pot's broken in half and some cups/saucers cracked. For £10 more she could have insured it and Hermes would then have paid for it. The woman's refusing to reimburse her saying it was well packed. IT WASN'T. She's sent her photos.


Wife's got a little business, sending glass and pottery to Philippines and selling them for a lot more than she paid. First time she sent a box full a lot broke but she packs them far better now, with loads of bubble-wrap and last 3 times nothing was broken. It's how well you pack them.

I'm fuming but woman says her husband's a solicitor and has said she's under no obligation whatsoever to repay her. Maybe not but kindness and consideration would make me refund the money if it was me.

What do you think? Wife says she doesn't really expect her to.

It's the sender's responsibility to pack the item properly, if it arrives obviously damaged then you have the the choice to accept or reject it but you have a period of time to raise an issue anyway under the various consumer rights acts.

It's all as boring as your question.

The seller, it's not your problem.

There is an insurance part in the sending contract, you can bump it up for a a little more but it's commonly around thirty five quid.

It's not your problem and you're entitled to a full refund.

Here's what Hermes have on their website.


NO PROTECTION ITEMS: The following items (or any item similar in description or content) can only be carried on a no protection basis on any service.

Any person sending such an item does so at their own risk:

POTTERY AND PORCELAIN (Amongst many others such as glass)

If she was a decent fucking seller she'd refund her though. I would.

it's set up for exactly things like this

i'd let her know you intend doing this and see what she comes back with

Small Claims Court is the next step , you say you have photos of the packing so this should help .

either that or accept the loss . Does this women have a web site how did you find her advert .
