MONTGOMERY, Ala. — A Muslim inmate scheduled to be executed next week in Alabama said the state is violating his rights by requiring a Christian prison chaplain to stand near him as he is put to death, according to a lawsuit filed this week.

Dominique Ray is scheduled to be executed Feb. 7 for the fatal stabbing of 15-year-old Tiffany Harville in 1995. Attorneys for the 42-year-old inmate have asked a federal judge in the suit filed Monday to stay his execution while the court considers his claim.

Attorneys for Ray said the prison warden refused Ray's request to have a Muslim imam stand in the execution chamber instead of the prison chaplain during the planned lethal injection. They said the warden also refused his request to not have the chaplain present during his execution.

While condemned Alabama inmates can visit with their own spiritual adviser before an execution — and have that person witness the execution from an adjoining room— only a correctional officer and the prison chaplain have been in the death chamber with the inmate during recent executions in Alabama.

Ray's attorneys said the chaplain's "mandatory presence in the execution chamber can serve only one interest — an unconstitutional one — safeguarding the soul or spiritual health of the condemned inmate in the Christian belief system."

For context I am an opponent of the death penalty - but I don't think that's relevant here.

If, as some are, you are an advocate of the death penalty surely there is no reason to deny a perfectly reasonable request to have a spiritual adviser appropriate to your religion and denomination. OK that may result in some Christian Fundamentalist Neo-Nazi having a White Supremacist pastor at his side or a Muslim terrorist having a Jihadi preacher but if you believe that putting people to death is a deterrent surely that's just all the better?

Certainly an advocate of the death penalty would just allow the condemned to have whoever the hell they wanted in the room just so long as the deed is done in a timely fashion.

I don't see the problem with letting this man have his way in either case.

Im an opponent of the death penalty not on moral grounds but because 1)the sentence is too selectively given 2) the death sentence is rarely a death sentence because of appeals.3) its too costly because of appeals 4) life in prison is a harsher sentence(if the imprisoned murderer isnt allowed to torment his victims thru access to outside people or to social media or computers of any kind)

RE: this situation...Give the damn guy his imam or whatever he wants and get on with the show. stop wasting time and money.You (whoever denied him his own religious guy) knew damn well that every little thing can get appealed nowadays .

Seems like Alabama is just trying get one more punitive shot at him as he is killed.

Let the guy have what ever religious person he wants, present at his death and get it over with.

Wasn't Alabama the state in trouble a couple of years back over buying the lethal drug they use via a third party supplier? I can't find the info now but seem to remember the pharma company were pretty annoyed as they didn't manufacture or market it for that purpose. The state pens had bought it off some back door dealer.

When you kill another human, you lose all human rights. No matter what religion you are. If he was a true believer he wouldn't be on death row for murder in the first place.

A U.S. federal court blocked Thursday’s scheduled execution of a Muslim inmate in Alabama on grounds the state may be violating his religious rights by refusing to allow an imam to be present at his death.

The 11th U.S Circuit Court of Appeals said on Wednesday it had granted an indefinite stay for Dominique Ray, 42, a day before he was scheduled to be executed by lethal injection for the killing of a 15-year-old girl more than 23 years ago.

A three-judge panel wrote that it appeared Alabama might be in violation of the Establishment Clause of the U.S. Constitution’s First Amendment, which deals with religious rights.

The state on Wednesday appealed the stay of execution.

The Alabama Department of Corrections (ADOC) denied Ray’s request to have his imam at his execution, saying that only ADOC employees could be present in the execution chamber, the state said in a court document.

A prison chaplain employed by the department is allowed to be present at executions but other spiritual advisers must witness executions from a viewing room, according to the state.

Ray was convicted in the fatal stabbing of 15-year-old Tiffany Harville, who disappeared from her home in Selma, Alabama, in July 1995. Her body was found in a field a month later.
